MEMBERSHIP TERMS AND CONDITIONS

These terms and conditions are entered into by and between Primal Fitness (hereinafter “PF”) and you (hereinafter “the Member”).

SERVICES

Membership entitles the Member to access Primal Fitness facilities, coaching services, and equipment as included within their membership type.

MEMBERSHIP

Membership is personal to the Member and may not be transferred or shared.

AGE LIMIT

Members must be 18 years or older.

Members aged 16–17 may train with written parental consent.
Anyone under 16 must be supervised at all times.

HEALTH

The Member confirms they are medically fit to participate in exercise.

If the Member has any concerns regarding their health, they must seek advice from a qualified medical professional before participating.

Primal Fitness does not conduct medical assessments and is not responsible for determining a Member’s fitness to train.

Any assessments carried out (e.g. body composition scans) are for progress tracking purposes only and are not medical or diagnostic tools.

LIABILITY

Members are responsible for any damage caused to equipment or facilities through misuse or negligence.

The Member agrees to cover the cost of any such damage.

WAIVER OF LIABILITY

All training and use of facilities is undertaken at the Member’s own risk.

Primal Fitness is not liable for:

  • Injury sustained during training
  • Loss or damage to personal property
  • Any incidents arising from use of equipment or facilities

Members must ensure they understand how to use equipment safely and follow coach guidance at all times.

PERSONAL BELONGINGS

Storage is limited. Members are advised not to bring valuables into the facility.

Any items left on the premises may be removed or disposed of if unclaimed.

LOST PROPERTY OR THEFT

Primal Fitness does not accept responsibility for lost or stolen items.

Unclaimed items will be held for up to 7 days before being disposed of.

CODE OF CONDUCT

Members must respect staff, other members, and the facility at all times.

Primal Fitness operates a zero-tolerance policy towards:

  • Abuse or intimidation
  • Disruptive behaviour
  • Unsafe use of equipment

SUSPENSION / TERMINATION

Primal Fitness reserves the right to suspend or terminate membership without refund if the Member breaches the code of conduct.

ACCESS & SESSION STRUCTURE

Access to the facility is via booked sessions only.

Session availability, class times, and coaches are subject to change.

Primal Fitness is typically open:

  • Monday–Friday: 6:00am – 8:30pm
  • Saturday: 7:00am – 12:00pm

Opening hours may vary.

BOOKINGS & ATTENDANCE

Members must:

  • Book sessions in advance
  • Cancel within the stated cancellation window

Late cancellations or no-shows may result in session loss or restricted booking access.

Memberships are not based on attendance, and unused sessions are not refundable.

PAYMENT

The Member is responsible for all membership payments.

  • Payments are collected via direct debit on either the 1st or 15th of each month
  • The first payment (or pro-rata amount) is taken upon joining

Membership continues regardless of usage.

If a payment fails:

  • Access may be suspended
  • The membership remains active and payable

If payment is not made within 30 days:

  • The full outstanding balance may become due
  • The account may be referred to a debt collection agency

The Member authorises automatic payment from their account.

CANCELLATION POLICY

Cancellation requires a minimum of 60 days’ written notice via email to:

The notice period begins from the date the email is received.

Membership payments will continue during the notice period.

RENEWAL

Membership automatically renews each month unless cancelled in line with the notice period.

EXCEPTIONAL CANCELLATION

Early cancellation may be considered in exceptional circumstances:

  • Medical condition preventing exercise (with medical evidence)
  • Relocation outside a reasonable travel distance (evidence required)

All requests are reviewed on a case-by-case basis.

FREEZE POLICY

Memberships may be paused with a minimum of 1 month’s notice.

  • Maximum freeze period: 2 months
  • Frozen time is added to the end of the membership

PRICE CHANGES

Membership prices may be reviewed periodically.

Any changes will be communicated with at least 30 days’ notice.

REFUNDS

Membership fees are non-refundable.

Unused sessions, missed sessions, or early cancellations do not qualify for refunds.

PHOTO & MEDIA CONSENT

Primal Fitness may capture photos and videos within the facility for promotional purposes.

By attending sessions, Members consent to the use of their image in:

  • Social media
  • Marketing materials
  • Website content

If a Member wishes to opt out, they must notify a member of staff.

GENERAL

Primal Fitness reserves the right to update these terms and conditions at any time.

Members will be notified of any significant changes.

Primal Fitness is the trading name of Primal Fitness (NE) LTD. We take your privacy seriously and as such have laid out the following privacy notice in line with the General Data Protection Regulation 2018.

 

By using our facility and any of our services you agree to be bound by the policies set out in this privacy notice. We are fully committed to protecting the privacy and safeguarding the use of your personal information and we will look to keep this privacy notice updated, therefore check back here regularly to review any amendments.

What data we collect and how we use it

We collect and process your personal information (such as name, date of birth, contact information, bank account and payment information and information relating to health conditions and usage) directly or via our specially selected partners, in order to administer your accounts and subscriptions with us – to process orders, payments or applications submitted by you.

 

We also use it to carry out our obligations in relation to any agreement or contract you have with us including any subscription to our service, or to verify your identity, or anticipate and resolve problems with any services supplied to you.

 

We will not share your data with any third party other than those utilised to service our business or if legally obligated to do so. External partners (processors) may be utilised to perform tasks including but not limited to: processing payments, making bookings, marketing, accounting and account management – we agree terms with all of our partners to ensure that they all comply with high levels of confidentiality and best practice in privacy and security standards in line with the General Data Protection Regulation 2018.

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we utilise various physical, electronic and managerial procedures to safeguard and secure the information we collect.

 

Information about products and services and marketing

From time to time we may send you details of products and services that may be of interest to you via email. This is only if you opt to receive this information, via informed opt-in consent or via legitimate interest, whereby you could reasonably expect to hear from us following a recent enquiry, purchase, content download or referral from someone you know

 

Your rights and keeping our records up to date and accurate

You can opt out from any promotional, non-essential or marketing content at any time by clicking the unsubscribe link in an email or by contacting us directly.

You may also contact us directly to request information about what data of yours is recorded by us, how it is stored and what it is.

If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible. You also have the right to lodge a complaint with a supervisory authority if you feel your privacy has been violated.

In general we retain and process personal data for a reasonable period following initial enquiry, purchase or the lapsing of an account with us. Certain records such as health screening forms may be retained for a longer period, in line with fulfilling contractual obligations of due care to our customers and visitors, in line with industry standards.

 

Third party sites, apps and services

We cannot be responsible for the privacy policies and practices of other websites, apps or services even if you access them using links from our sites, or during the delivery of our services. We recommend that you check the policy of each site you visit, any apps you use or any third party services that you may register with.

 

Social Media

We advise Members and visitors to not record or take photographs within the premises if there is the chance of including other individuals in the background. We do occasionally arrange filming or photographs for use on our Social Media or other communications. All due care will be taken to ensure that no one appears in filming or content created by us without expressing consent to be included. If you find you do appear in error, and would like an image or video to be removed from our Social Media channels or communication please contact us immediately.

Use of Cookies

A cookie is a very small text document, which often includes an anonymous unique identifier. When you visit a website, that site’s computer asks your computer for permission to store this file in a part of your hard drive specifically designated for cookies. Each website can send its own cookie to your browser if your browser’s preferences allow it, but (to protect your privacy) your browser only permits a website to access the cookies it has already sent to you, not the cookies sent to you by other sites.

 

IP Addresses

IP addresses are used by your computer every time you are connected to the Internet. Your IP address is a number that is used by computers on the network to identify your computer. Restricted Access

We may in the future need to restrict access to parts (or all) of our website and reserve full rights to do so. If, at any point, we provide you with a username and password for you to access restricted areas of our website, you must ensure that both your username and password are kept confidential.

Other than the disclosures referred to in this policy, we will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about third parties which we think you may find interesting and if you tell us that you wish this to happen.
